Drug and alcohol Clearinghouse: what a one-truck owner-operator has to do

Updated

If your operation requires a CDL, you're both the employer and the driver under the federal testing rules. You buy Clearinghouse queries at $1.25 each, query each driver before they start and at least every 12 months and name a consortium (C/TPA) in the Clearinghouse.

Who the testing rules cover

The testing and Clearinghouse rules in 49 CFR Part 382 cover operations that require a CDL. If you drive your own truck under your own authority, you count as both the employer and the employee, so you carry both sets of duties.

A CDL requirement is what brings you under Part 382, and a USDOT number alone doesn't. Trucks that don't need a CDL fall outside these testing rules. A DOT medical certificate can still apply, because it covers some non-CDL drivers of interstate commercial vehicles.

The consortium rule for one-truck owner-operators

As a self-employed CDL driver you have to:

  1. Designate a consortium or third-party administrator (C/TPA) in the Clearinghouse. It reports violations for you.
  2. Join a random-testing pool with at least two covered drivers. Owner-operators join a consortium because a one-driver company can't run a pool by itself.

Buy query plans and designate your C/TPA at clearinghouse.fmcsa.dot.gov.

For 2026, FMCSA's minimum random testing rates are 50% for drugs and 10% for alcohol. Those rates apply across the whole pool, so they don't tell you how many times you'll be tested.

Published consortium prices, October 2026:

Provider Yearly enrollment Tests
Vertical Identity $85 for the first driver, $25 for each additional driver Billed separately. $69 per DOT drug test
OOIDA CMCI $170 if the owner serves as designated employer representative (DER), $145 if someone else does $85 pre-employment drug test

The OOIDA amounts come from a May 2025 fee sheet. Confirm current prices and membership terms before you sign up. Consortium and testing charges come from the provider, separate from FMCSA's $1.25 per query.

Ready for Loads isn't affiliated with FMCSA or any consortium.

Queries and what they cost

Query When Driver consent Price
Full Before a driver does any safety-sensitive work Specific electronic consent inside the Clearinghouse $1.25
Limited or full At least once every 12 months for each current CDL driver Limited: general consent outside the Clearinghouse $1.25
  • You buy query plans yourself. A consortium can't buy them for you.
  • Unused queries don't expire.
  • A limited query followed by its linked full query is charged once.
  • If a limited query turns up a record, run a full query within 24 hours. Until a full query clears the driver, keep them off safety-sensitive work.

You need a verified negative pre-employment drug test before safety-sensitive work starts, and a query doesn't replace it.

Reporting a violation

An employer reports a drug or alcohol violation to the Clearinghouse by the close of the third business day after getting the information. Medical review officers have their own reporting duties.

Testing and the new entrant audit

The new entrant safety audit fails you automatically if you have no testing program or no random testing. Enroll before your first load so your records are complete when the auditor asks.

Frequently asked questions

How much does a Clearinghouse query cost?

Each full or limited query costs $1.25. A limited query followed by its linked full query is charged once.

Do owner-operators need a consortium?

Yes, if your operation requires a CDL. You designate a C/TPA in the Clearinghouse and join a random-testing pool with at least two covered drivers.

How often do I query a driver?

Run a full query before a driver does any safety-sensitive work. After that, run at least one query every 12 months for each current CDL driver.

Does a USDOT number put me under the testing rules?

Not by itself. The Part 382 testing and Clearinghouse rules cover operations that require a CDL.
